Iraq War Veteran Told to Remove American Flag From Outside of Home

In 2005, Congress passed The Freedom to Display the American Flag Act. The bill lets citizens fly the American flag from their homes regardless of any restrictions set in place by the community. Homeowner associations are only allowed to implement the “time, place, or manner of displaying the flag.” Yet, Virginia resident Daniel Toner, an Iraq war veteran, was told that he had to receive approval of the HOA to display the American flag outside of his rented home in Suffolk, Virginia. This was after he was initially told he could fly the flag outside of his house. Toner told WAVY-TV “This is something that shouldn’t be happening here in Hampton Roads."

He noted that an email, from the property manager Kimberly Katz, said he could fly the flag from his porch. Then, he said he received a letter in the mail asking him to take down the flag until they passed a resolution saying it was okay to have a flag holder in front of your house. Toner said, "It's absolutely ridiculous. You shouldn’t even have to ask permission to have an American flag on your property. That’s a right according to Congress.”

According to the Chesapeake Bay Management President Dana Shotts-Neff, the homeowner association has “no intention of denying anyone the right to fly the American flag.” Yet, the flag represents an alteration to the home--something homeowners can only do through an application process. In response, Toner said “That flag is staying right where it is."
