He Did This In Front Of Elderly Woman, Cops Immediately Put Him In Handcuffs

In yet another case of a foolish teenager and a police department that doesn’t understand that it is a generally not a good idea to criminalize minor situations where no one is hurt or no stolen property is involved.

In this rather bizarre case, it seems that an 18-year-old man was arrested for cursing in the presence of a 75-year-old woman. The incident occurred in Louisiana.

According to local media sources, a man named Jared Dylan Smith was arrested and booked into jail on a disturbing the peace through language and disorderly conduct charge in early April of this year. The Ouachita Parish Sheriff’s Office notes that Smith’s bond has been set at $200.

The police report notes that the complainant claimed that Smith was standing next to her when he yelled a curse word and “clearly disturbed her peace”. Apparently, Smith has denied uttering an expletive.

No reason has been provided for Smith’s uttering the curse word or for the disturbance in general.

Note that the law in Louisiana says a person can be arrested for disturbing the peace by “addressing any offensive, derisive, or annoying words to any other person who is lawfully in any street, or other public place; or call him by any offensive or derisive name, or make any noise or exclamation in his presence and hearing with the intent to deride, offend, or annoy him, or to prevent him from pursuing his lawful business, occupation, or duty.”

This rather broad description in the statute give police a great deal of latitude to arrest people for very minor violations of the personal space of others, and is often used by police as an excuse to arrest people so they can interrogate them or simply as harassment.

Keep in mind that Smith could face up to 90 days in jail and have to pay $100 in fines if he is found guilty of disturbing the peace.
