Woman Told Her Husband Baby Died, But She Actually Sold It To Another Couple

A U.S. soldier from Arizona has been through an emotional wringer. While he was stationed in South Korea, he got word from his wife that their newborn baby died.

The devastated soldier found out a month later that his wife actually sold the child. When fighting for custody, he learned that he wasn't the baby's biological father.

Sgt Steven Garcia, a 24-year-old patrol supervisor in Seoul, got news while overseas that his 31-year-old pregnant wife, Marina, went into labor. Things did not end well, and Garcia was told that his baby girl died in childbirth.

Garcia's sister got the news first, then called her brother to deliver the tragic news. "When my sister called me about that, it was pretty emotional," he said. "We cried quite a bit together over the phone. It was devastating."

The family thought that was the end of the story, but there was more to come. As it turns out, Marina did not give birth to a baby girl at all, she gave birth to a boy. Also, the baby did not die; he was alive and well.

An Arizona highway patrolman pulled over a couple for speeding. They were headed back home to Texas with a child. The patrolman felt the couple seemed nervous, so he started questioning them.

Alex Hernandez, the man in the car, admitted that he and his wife, Leslie, were not the biological parents of the child, who was three days old at the time. The couple admitted to signing a fraudulent birth certificate. They had purchased the child from their friend, Marina Garcia.

Alex and Leslie Hernandez pleaded guilty to conspiring to commit forgery. Marina pleaded guilty to a felony count of a fraudulent scheme. Alex and Leslie were each sentenced to four years of supervised probation while Marina will be sentenced next month.

Neither have been charged yet for the sale of the baby since there is no evidence that any money changed hands.

The baby, who has been named Leo, was given to Arizona's Department of Child Safety and he is currently in foster care.

Garcia was shocked when he discovered that his baby was still alive, and is fighting for custody of Leo. There is one hitch, however: he's not the biological father of the child.

When he was told by authorities that his wife says the baby was not his, he couldn't believe it. "I was under the assumption the entire time that she was pregnant that I was the father," he said, noting that the couple had sex in May, just before he left for South Korea. That is about the time the baby would have been conceived.

"When I found out...I was kind of in denial. I couldn't believe what was going on."

Garcia has filed for divorce, but he still wants custody of Leo. He himself was adopted, so he says it doesn't matter to him if he's biologically related to Leo.

"My adopted father completely changed my life," he said. "Without him, I would not be where I am today... The opportunity to do that for someone else, I believe it's important. It could change the child's life and give him a better future. I believe that's the right thing to do."
