Lawyer: NJ Teacher Had Sex With Students Due To Brain Damage

Medical experts know that brain damage can have an impact on a wide variety of physical, intellectual and emotional functions. That’s why it’s not too surprising to hear that a high school teacher on trial for having sex with six male students has a brain condition that left her “defenseless” against the students' aggressive behavior, according to her attorney.

Ex-teacher Nicole DuFault, 36, of Caldwell, NJ pled not guilty earlier this year to charges of aggravated sexual assault and child endangerment. DuFault had been working as an English teacher at Columbia High School in Maplewood before she was arrested last fall.

According to prosecutors, the victims of DuFault’s behavior were 14- and 15-year-old boys, and the assaults happened a number of times between 2013 and 2014. They allege the sex acts took place both on school property and in DuFault's car.

DuFault’s Lawyer, Timothy Smith, explained to NJ.com that his client is suffering from "frontal lobe syndrome," which brain experts say can often lead to socially inappropriate behavior. An inability to control impulses is another known symptom of the condition.

He went on to note that DuFault's condition relates to brain surgery she had after complications from her first pregnancy. A shunt had to be put into her brain because of fluid swelling, and she suffered brain damage as a result.
