Jury Makes Terrible Mistake When Trying To Sentence Man To 10-Years In Prison

A Texas jury was charged with deciding the sentence for a drunk driver who severely injured a child. When they were filling out the verdict form, they made a costly mistake - instead of the prison sentence they meant to give him, they let him out on probation.

Sammy Carl Williams, 48, was driving under the influence when he crashed into a young boy. The boy survived, but his injuries were extensive. He ended up losing a leg.

The jury had meant to sentence Williams to 10 years in prison, and probation after that. They mistakenly checked the boxes and ended up giving him probation only. As the judge read the sentences, everyone realized something was wrong.

"I called the bailiff to come over and said this is a mistake, but it was too late, it was done,” said Jenni McLelland, the jury foreman. "Two of the jury members got very upset and cried because we did not intend for him to just go free and that's essentially what happened."

It's unusual for the state to appeal a sentence, but the prosecutor has filed an appeal. It's expected to be an exhausting, tedious procedure to change the ruling, but the jury and the young boy's family are hoping it will happen.

"I want him to go to prison. I don't want him to hurt anyone else," said Gloria Hernandez, the victim's mother.
