Judge Gives Man Unusual Sentence - This Way He'll Never Forget The Woman He Killed

A man in Texas who killed a woman in a drunken driving accident will be reminded of his crime by a week in jail on the anniversary of her death for nine years.

Travis Elwell, a resident of Mesquite, Texas, was sentenced to four months in jail for the 2015 death of 34-year-old Emily Javadi, who was killed standing next to her car after a workout in Dallas. Elwell had a blood alcohol content of 0.175 at the time, and was speeding when his BMW hit Javadi’s Lexus, and smashed her into a pole.

In a plea deal approved by Javadi’s parents and prosecutors, Elwell is also required to serve one week in jail on the anniversary of Javadi’s death for the next nine years, according to local media reports.

“That was the only thing that was important to us,” Javadi’s father, Michael, explained in an interview last week. “That there needs to be some sort of accountability for the irresponsible actions that he took.”

The family says they were not interested in seeing Elwell locked up for life, but came up with the creative sentence based on advice given to them by their attorneys that drunk drivers convicted of intoxication manslaughter sometimes just receive probation.

“We’re not going back to look at the negative, she was not a negative person,” Javadi’s mother, Karen, noted. “And we made it. We’re going to make this.”

Texas attorney Nicole Knox (not associated with the case) said she frequently works on similar cases and said this punishment was definitely unique.

“To have that annual reminder and the purpose of the annual reminder, while you’re sitting in solitude incarcerated, I think it’s a really creative way to create more of a deterrent effect,” Knox commented.

Of note, the terms of Elwell’s probation specify he may not drink alcohol, must go to Alcoholics Anonymous meetings and give talks at meetings of drunk driving support groups.
