Foster Parents Heartbroken That Foster Daughter Must Be Removed Based On Ethnicity

Lexi is a six-year-old and 1.5 per cent Choctaw Native American who was torn away from the only family she's ever known. The reason is Lexi's foster parents, Summer and Rusty Page, are not Native American.

A federal law passed in the 1970s, called the "Indian Child Welfare Act" was created to protect the best interests of Native American children. As a result, Lexi is required to live with Native American parents. Any day, Lexi can be taken from her Santa Clara, California home.

Summer and Rusty have been fighting for two years to adopt Lexi. Yet, a court-ordered emergency stay has been lifted. In fact, the Choctaw Tribe has decided to place Lexi with a person in Utah who is neither Native American and does not live on a reservation.

Rusty told Fox 11, "Lexi doesn't know another home. She finally knows what mom and dad means and they want to take that away from her. And we can't stand idly by while that happens."

At 10 a.m. on Sunday, Department of Children and Family Services agents were expected to take Lexi from her home. They postponed the retrieval after a large group of protesters took a stand.

Lexi's foster grandmother told ABC 7, "As a grandmother, it's ripping my heart. It's ripping me apart to see Lexi has been a part of our family for almost five years, and she's not going to understand what's going on. The children are not going to understand the separation. It's going to destroy these children."

More than 20,000 people have signed a petition to keep Lexi with her foster family.
