Judge Finds Muslim Woman 'Solely Responsible' for Police Confrontation

A Muslim woman in Belgium has received an 18-month prison sentence relating to an incident in a police station after being arrested for refusing to take off her niqab (full face veil).

Stephanie Djato was arrested back in May of 2012 at a bus stop in the Brussels. She was requested to remove her niqab, the cloth face covering that forms part of the hijab female clothing per Belgian law, but she refused to do so.

Djato also resisted arrest, but was forcibly transported to a police station. She continued to resist on the way to the station, and injured a female police officer with a head butt.

At the police station she continued her violent actions, and two women police officers were injured and Djato was taken to hospital.

A local newspaper report earlier this week notes the court determined that Djato responsible for the situation, giving her a prison sentence of 18 months and a 900 euro fine. She is also required to pay compensation to the police officers she attacked.

The Belgian law that prohibits the niqab came into force in April 2010. The law bans “attire and clothing masking the face in such a way that it impairs them from being recognizable”.

Of note, the penalty breaking the no-niqab law is less serious than the sentence Djato received due to her violent actions.

The anti-Niqab law in Belgium was passed for security reasons. It still led to anger and complaints from the Islamist community in Belgium and elsewhere, and there were violent protests after Djato’s arrest.

Back in 2012, Mulsim fundamentalist group led protests supporting Djato that turned into riots. Two police officers were also wounded in an attack in a Brussels Metro Station by a French Islamist. The man apparently came to Brussels from Paris to launch the attack as a protest against Belgium’s policies about Muslims.

Djato did not attend her trial, but an order for her immediate arrest has been issued following her conviction.
