Judge Rejects ‘Birther’ Lawsuit Against Ted Cruz

A court ruling has cleared the way for Ted Cruz to take part in Pennsylvania’s Republican presidential primary in April, LawNewz reported.

The Texas senator’s political opponents, including GOP front-runner Donald Trump, filed a lawsuit arguing that he is ineligible to be on the ballot because he was born in Canada. A judge rejected the claim.

Rachel Stockman of LawNewz noted that few news reporters paid attention to the ruling. “This weekend, it occurred to me, this issue has faded from the public eye,” she wrote. “The major media outlets stopped talking about it, maybe because Trump has moved on to other things, but it remains an important and largely unresolved question.”

Similar suits suggesting that Cruz is not a “natural born citizen,” as the Constitution requires, are pending in other states. The candidate and his supporters insist he meets the definition because his mother was a U.S. citizen.

The judge in Pennsylvania, Dan Pellegrini, cited a memo the U.S. Immigration and Naturalization Service’s general counsel wrote in 1968. It stated: “The framers were well aware of the need to assure full citizenship rights to the children born to American citizens in foreign countries.”

Newsmax pointed out that another memo, which the Congressional Research Service issued in 2011, maintained that “being born abroad to U.S. citizen-parents” meets the “natural born citizen” mandate.
