Court Rules Against Concealed-Carry Gun Rights

In a potentially major setback for gun owners, a liberal federal court decided Thursday that the Second Amendment does not guarantee the right to carry concealed firearms in public places.

The 9th Circuit Court of Appeals ruled that the government may refuse concealed-carry permits to anyone whom officials consider dangerous. Legal analysts do not expect the U.S. Supreme Court to take up the case, according to the Reuters news agency.

In a 7-4 vote, the justices on the San Francisco court determined that two counties in California are not violating the Constitution by denying permits to residents who fail to demonstrate “good cause.” The counties require applicants to prove their jobs put them at risk, or that they have been threatened with violence.

“We hold that the Second Amendment does not protect, in any degree, the carrying of concealed firearms by members of the general public,” Judge William Fletcher declared in the 52-page majority opinion. Judge Consuelo Callahan, in a dissenting opinion, argued that “the Second Amendment is not a ‘second-class’ amendment.”

Reuters pointed out that other appeals courts previously confirmed that New York, Maryland and New Jersey may limit the permits to certain approved residents. Three years ago, the Supreme Court passed up an opportunity to settle the legal argument whether the Constitution ensures the right to bear arms. The question is still unresolved, as the 9th Circuit Court addressed only concealed-carry permits.
